Legal Notice

The User warrants that all data submitted or provided to MENARINI, particularly personal data, will be accurate, up to date and truthful.

The User undertakes to use the Website and all its content and services in accordance with the law, morality, public order and this Legal Notice. Likewise, the User undertakes to make appropriate use of the content of the Website and not to use it to carry out unlawful activities or activities constituting a criminal offence, that infringe the rights of third parties and/or that breach intellectual or industrial property regulations, or any other applicable legal provisions.

The User undertakes not to transmit, introduce, disseminate or make available to third parties any type of material or information (data, content, messages, drawings, photographs, software, etc.) that is contrary to the law, morality, public order or this Legal Notice.

By way of illustration, and in no case limiting or exhaustive, the User undertakes to:

• Not introduce or disseminate through the Website any data programs (viruses or harmful software) capable of causing damage to the computer systems of any third party.
• Not disseminate, transmit or make available to third parties any type of information, element or content that infringes the fundamental rights and freedoms of third parties, or that may involve a violation of the intellectual or industrial property rights held by the owners of the Website or by third parties.
• Not disseminate, transmit or make available to third parties any type of information, element or content that constitutes unlawful or unfair advertising.
• Not transmit unsolicited or unauthorized advertising, promotional material, "junk mail", or any other similar form of advertising.
• Not introduce or disseminate any false, ambiguous or inaccurate information or content in a manner likely to mislead recipients of the information.
• Not impersonate other Users by using their access credentials to the various services and/or content of the Website.
• Not disseminate, transmit or make available to third parties any type of information, element or content that involves a violation of the secrecy of communications and personal data legislation.

In the event of registration, the User will at all times be solely responsible for safeguarding their access credentials, including their password, and will accordingly bear any damages arising from their improper use, as well as from the transfer, disclosure or loss of such credentials. For these purposes, use of the services and content carried out under a registered User's password will be deemed to have been carried out by that User, who will in any case be liable for such access and use.

The User undertakes to hold MENARINI harmless from any possible claim, fine, penalty or sanction that it may be obliged to bear as a result of the User's breach of any of the rules of use indicated above, with MENARINI reserving the right to seek any corresponding compensation for damages.

Pursuant to the applicable regulations on medicinal products, the content and information on the Website is directed solely at healthcare professionals authorized to prescribe, recommend and dispense medicinal products, such that access to that information and content is restricted exclusively to such healthcare professionals.

All information, materials, scientific, technical or commercial data to which the User has access through the Website is confidential. In this regard, the User undertakes to:

• Maintain the strictest professional secrecy with respect to such information.
• Not disseminate, communicate, publish or distribute the content to unauthorized third parties.
• Use the information exclusively for their professional updating and within the framework of their clinical practice, with any commercial or extractive use unrelated to the purposes of the Website being prohibited.

For these purposes, when a User seeks to access such content, MENARINI will require that User to expressly declare that they are a healthcare professional and to create their access credentials in order to access such content.

Where the User is not a healthcare professional, the User must refrain from accessing such content, since it is directed solely at healthcare professionals with the authority to prescribe medicinal products.

The User assumes sole responsibility for the declaration they make regarding their status as a healthcare professional, such that MENARINI will assume no liability that may arise from a false declaration by that User, who undertakes to hold MENARINI harmless from any possible claim, fine, penalty or sanction that may be imposed under such a scenario.
